Terms and conditions

1. Agreement

European Forest Institute ("EFI") provides and maintains the Land-use Planner website ("Site") free of charge for you.
By accessing the Site, you agree to be bound by these terms and conditions.
EFI may change these terms and conditions at any time. By continuing to access the Site following any change, you accept and agree to be bound by all changes.
The Site, as well as content on the Site, may be modified or discontinued without notice.

2. Content

The Site is maintained to provide access to the Land-use Planner tool, methods and data for participatory land-use planning.
The Land-use Planner has been produced with the assistance of the European Union. The content of this tool is the sole responsibility of the European Forest Institute (EFI) and can in no way be taken to reflect the views of the EU.
The land-use data available in the Website has been compiled through EFI’s own projects in tropical regions – based on direct observations, field surveys, interviews with local experts and secondary sources – and through data compiled by other users of the Land-use Planner tool.
You are aware of the inherent limitations of sharing land-use data from different contexts and should only be used as second-best estimates for land-use information in the absence of better information.
You may not post spam, access the Site or collect the content of other users or information using automated means, upload viruses or other malicious code, solicit login information or access an account belonging to someone else, use the Site to do anything unlawful, misleading, malicious, offensive, or discriminatory, do anything that could disable, overburden (e.g. impair the proper working of the Site), or facilitate or encourage any violations of these terms and conditions.

3. Registered user content

You will have access to more functionalities including: inputing your own data, managing it, saving projects, work collaboratively in teams, customize the Land-use Planner interface to your own context and community of users.
You accept that any of the land-use data introduced there may be used, completed or repackaged by EFI for non-commercial use with a view to enrich the Site with additional land-use data that may be relevant to the community of users.

4. Intellectual Property Rights

You may not use the Site or content on the Site in any way that infringes the intellectual property rights of EFI or any other party. You therefore have to be aware of copyrights, trademarks, patents and other proprietary rights and laws that may apply to specific material within the Site.
By adding, uploading, submitting, distributing, posting to, creating, or making available content through any similar action you grant EFI a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use that content, for the duration of intellectual property rights protection. You represent and warrant that your actions don’t infringe upon the rights of any third parties.
All content on this page is licensed to you under Creative Commons license CC BY-NC-ND 4.0.
You may not imply that the EU, EFI or the EU REDD Facility authorises or endorses your use of the data, or use the EU, EFI or EU REDD Facility names, abbreviations, logos, or emblems in conjunction with such use.

5. Third party links

The Site may contain links and references to third-party websites. These are provided for your convenience and interest. For EFI, this implies neither responsibility for, nor approval of, information contained in these websites.

6. Limitation of liability

The use of the Site and the use of information received through the Site is at your own risk.
The information from or through the Site are provided "As-is," "As available," without warranties, express or implied (including but not limited to accuracy, availability, completeness, fitness for purpose, non-infringement or reliability).
The quality of the results of a Land-use Planner simulation is based on the quality of the data entered and on the ability of the Land-use Planner user to develop relevant scenarios, reflecting adequately the planning priorities and stakeholders’ views. Possible shortcomings in a land-use planning process cannot be attributed to the Land-use Planner.
A critical approach is needed when using land-use data estimates from other sources than direct observation from the area of interest. Indeed, land-use data is highly context-specific; the accuracy and relevance of land-use data generally diminishes when applied outside its original geographic and social particular context.
The information and services may contain bugs, errors, problems or other limitations due to the evolution of the Site. In case you suspect any error in the results of your Land-use Planner analysis, you always have the possibility to download the detailed results of your Land-use Planner project to verify or redo the calculations.
EFI has no liability whatsoever for use of any information or service provided through the site. In particular, but not as a limitation thereof, EFI is not liable for any direct, indirect, special, incidental or consequential damages (including damages for loss of business, loss of profits, litigation, or the like).
You confirm and agree that EFI is not liable for any conduct of any user of the Site.

7. Indemnification

You agree to indemnify EFI from and against any and all actions, claims, losses, damages, liabilities and expenses arising from your use of the Site.
